1. USING YOUR E-GIFT CARD WITH BOATAFFAIR
1.1 These terms and conditions (together with any relevant documents referred to in them (including the Website terms of use)) set out the terms relating to the redemption of any Boataffair E-Gift Cards (“the E-Gift Card”). The details of the E-Gift Card will be set out in the description of the specific promotion (i.e. on the E-Gift Card itself or on our website www.boataffair.com) and the specific terms and conditions for the E-Gift Card. Please note that our standard Terms of Use and our Privacy Policy as displayed on our website (www.boataffair.com) apply in respect of any orders placed using the E-Gift Card.
1.2 By confirming your order of the E-Gift Card and by using the E-Gift Card you are accepting these terms and conditions. Any terms which you seek to impose in respect of the order for the E-Gift Card through this site will not form part of any contract between us. Please read these terms and conditions carefully before confirming your order. If you have any queries on these terms please contact us before ordering or using an E-Gift Card.
2. TERMS RELATING TO THE REDEMPTION OF E-GIFT CARDS
2.1 How To Redeem E-Gift Card - You must sign up via the web address (www.boataffair.com) when placing your order online.
2.2 Only one E-Gift Card can be used per order of Product (a boat rental that is).
2.3 You cannot use an E-Gift Card in conjunction with any other sales discounts or promotional offers unless the specific terms relating to the Promotional E-Gift Card state that you can combine the E-Gift Card with other offers.
2.4 E-Gift Cards can only be used for one order.
2.5 The E-Gift Card will expire on the date specified on the E-Gift Card, or before subject to availability of which we will notify you via the website. You cannot use the E-Gift Card after this date.
2.6 E-Gift Cards have no cash redemption value.
2.7 Our standard Terms of Use as displayed on our website (www.boataffair.com) apply in respect of any orders placed using E-Gift Card.
2.8 We reserve the right to vary or discontinue the E-Gift Card scheme at any time.
3. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
3.1 We have the right to revise and amend these terms and conditions of sale from time to time including to reflect changes affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our site's capabilities.
3.2 You will be subject to the policies and terms and conditions of sale in force at the time that you use your E-Gift Card, unless any change to those policies or these terms is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you).
4. LAW AND JURISDICTION
These Terms and Conditions shall be governed by the laws of Switzerland. The Conflicts of Laws Rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply. All disputes shall be decided exclusively by the ordinary courts at the court of the registered office of Boataffair, in Canton Aargau.
